Defense Verdict for Sturgill Turner Med Mal Defense Team
Sturgill, Turner, Barker & Moloney’s medical malpractice defense team won a unanimous defense verdict in favor of a Lexington physician in a medical negligence lawsuit arising from a sinus surgery.
The plaintiff alleged that the surgery to treat her nasal condition worsened her condition, causing a permanent, life-long condition of constant shortness of breath, and that based on her original complaint, the sinus surgery was not necessary or appropriate for her condition. The medical expert called by the defense refuted these claims, showing that the surgery was appropriate and performed within ENT standard of care.
The plaintiff sought more than $4 million in damages for physical injury, pain and suffering, and mental anguish, later reduced to more than $1 million at the end of the trial. After a 3-day trial, the jury returned a unanimous defense verdict.
The experienced trial team included attorneys Pat Moloney and Doug Stephan, along with paralegal Jess Villagaray. The case was tried in Fayette Circuit Court, Div. IV, on March 6-8, 2023, before Judge Julie M. Goodman.
