Defense Verdict for Sturgill Turner Insurance Defense Team!
The Sturgill Turner Insurance Defense team won a unanimous defense verdict in favor of a Kentucky retailer in a premises liability suit in Logan Circuit Court on January 11, 2023.
The plaintiff alleged that she slipped in a substance on the floor and injured her back while shopping near the store’s dairy cooler. Surveillance cameras in the store did not capture the fall, though there was footage of the moments leading up to and immediately after the incident. There were no witnesses to the alleged fall. As a result, the Plaintiff (age 24) alleged injury to her low back that ultimately required a lumbar fusion and a subsequent hardware removal surgery.
The plaintiff was represented by one of the nation’s largest plaintiff’s firms, and sought past medical expenses, future care, plus past and future pain and suffering for a total demand of close to $3 million. After a three-day trial, the jury deliberated three hours before returning a unanimous defense verdict.
