Medical Malpractice Team Secures Unanimous Defense Verdict
Today Sturgill Turner’s Medical Malpractice Defense team secured yet another defense verdict in a four-day trial outside of Lexington. This was a medical negligence case arising out of a 2013 colonoscopy and hemorrhoid banding procedure performed by the defendant surgeon.
The plaintiff alleged that the surgeon should not have performed the procedure, negligently performed the procedure, and did not treat him appropriately after the procedure. Plaintiff developed a serious infection and lasting injuries. The doctor defended that the procedure was warranted, that he performed the procedure correctly, and that he appropriately monitored the patient post-operatively.
Plaintiff asked the jury to award $7.8 million in damages. The jury deliberated for approximately 90 minutes before returning a unanimous defense verdict.
